What is New York`s Green Light Act and what does it mean for you if you live in the United States without legal status? Here`s what you need to know. This landmark law will protect a quarter of a million New Yorkers by restoring their ability to get a driver`s license, while making our roads safer, our economies stronger, and our communities healthier for all New Yorkers. Now it`s up to the governor to decide. Cuomo will truly be the advocate for New York immigrants he claims by immediately signing the Green Light Act. This law allows the Department of Motor Vehicles to issue standard driver`s licenses and restricts information about who applies for or holds licenses from being stored and shared. Keep in mind that there are also people who could be considered undocumented but technically have the right to be in the country. Here`s what we know so far. If you`re an undocumented immigrant, New York`s Green Light Act allows you to apply for a driver`s license or apprenticeship license and drive legally on all roads in the state.

The question is: who is an undocumented immigrant? If you don`t have proof that you have a Social Security number, a Social Security ineligibility letter has been issued by the Social Security Administration, or if you don`t have proof of your legal status in the United States, your standard driver`s license does not comply with the federal REAL ID law. In accordance with the law, all licenses that do not comply with REAL ID standards will be marked as “NOT FOR FEDERAL USE.” This also means that after May 3, 2023, you will no longer be able to use your license to board a domestic flight (in the United States) or enter certain secure federal vessels. The Justice Department only accepted the data revocation provision, calling it “legally suspect” and questioning whether it violated federal law. There are certain requirements that a driver must meet to get a New York license. Effective December 16, 2019, the New York DMV will accept any form of identification on its License and Approval Documents Guide. If you are an unauthorized immigrant, you will not be able to participate in the next election scheduled for later this year. Non-citizens, including those with permanent resident status, are not allowed to vote in local, state, or federal elections. Even then, the DMV must notify the person at the center of a federal agency`s investigation within three days. All DMV offices offer language access assistance to individuals with limited English proficiency. She questioned whether citizens with enhanced driver`s licences – which allow the licence holder to cross the Canadian border – can re-enter the United States if customs officers do not have access to the database.

This law creates an authorization card for the driver and allows applicants, regardless of their legal status, to present birth certificates or passports issued by another country as proof of identity. The Act also prohibits the disclosure of legal status information for immigration law enforcement purposes. This law allows individuals to qualify for a driver`s license, driver`s license, or ID card even if the person does not reside legally or only temporarily in the United States if certain conditions are met, such as filing state tax returns. “The ability of Border Patrol agents to effectively do their job is a major mistake, and I urge you to consider the safety of all Americans by immediately reversing this decision,” Stefanik wrote. Obtaining a driver`s licence before the roadside test provides immigrants with the opportunity to gain valuable driving experience. Drivers under the age of 18 must pass the written exam and complete at least 50 hours of supervised driving training with 15 hours of night driving. This law provides driver`s licenses to applicants who present a valid foreign passport or consular identification and proof of residency, regardless of their legal presence in the United States. Applicants must file an application for legalization once they are eligible for states to issue driver`s licenses under the constitutional authority of the 10th Amendment. Congress enacted Real ID in 2005 and created standards for state-issued driver`s licenses, including proof of legal status. This letter provides a summary of state legislation authorizing driver`s licenses or authorization cards for unauthorized immigrants.

Seventeen states and the District of Columbia have passed laws allowing unauthorized immigrants to obtain a driver`s license. These states (California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maryland, Nevada, New Jersey, New Mexico, New York, Oregon, Rhode Island, Utah, Vermont, Virginia, and Washington) issue a license when an applicant provides certain documents, such as a foreign birth certificate, foreign passport, or consular card, and proof of current residence in the state. Valdés, co-executive director of Make the Road New York, said, “Today`s Senate vote is a vote for the history books and marks a historic victory for immigrant families across New York City who have led the fight for respect and dignity for our communities. New York immigrants knocked on thousands of doors on Long Island alone, collected thousands of petitions, held countless town halls, and traveled to Albany almost daily to get this legislation passed. Passing the green light will bring tremendous benefits to all New Yorkers, boost our state`s economy, create economic opportunities for immigrants, improve road safety, and keep families together. It`s up to you, but there are a number of things to consider. In addition to proof of citizenship or legal presence, REAL IDs and extended driver`s licenses require an SSN and two separate proofs of New York City residency. When you apply for a REAL ID or extended license, the DMV also scans and stores electronic copies of the documents you use to prove your age and identity for at least 10 years. This is necessary for New York to be considered compliant with the REAL ID Act of 2005, which the NYCLU and ACLU have long opposed. REAL ID and extended licenses are considered REAL ID compliant.

Some people find it more convenient to have a REAL ID card with them for travel purposes, although travelers can also use a valid passport at airports.
